Since tribunal fees were abolished in July, there has been a sharp increase in the number of claims. In addition, claimants who did not bring a potential claim at the time, because of the requirement to pay fees, may now be able to resurrect a claim. It’s a worrying time for employers.
There have been reports that some employers have responded to the risk of “zombie claims” by auditing all employment disputes over the last four years. Such an audit should also explore whether the relevant evidence and witnesses would be available, should the case be resurrected.
Whilst the principle of access to justice is very important, the removal of the fees system represents a challenge for employers. We may see more speculative claims from disgruntled employees, or even job applicants who have been rejected at the interview stage!
